ADVERTISING AGREEMENT
MY ZIP ADS LLC – ADVERTISING AGREEMENT
Last Updated: September 2026
This Advertising Agreement (“Agreement”) is entered into between My Zip Ads LLC (“Company”) and the undersigned business (“Advertiser”).
By submitting payment or signing this Agreement, Advertiser agrees to the following terms and conditions.
βΈ»
1. SERVICES PROVIDED
My Zip Ads LLC provides shared direct-mail advertising primarily through postcards distributed using the United States Postal Service, including USPS Every Door Direct Mail (“EDDM”).
My Zip Ads’ standard direct-mail campaign is generally designed to reach approximately 10,000 residential delivery addresses per scheduled mailing. However, the size and configuration of an individual Mailing Area may vary based on geography, population and housing density, USPS carrier routes, local market characteristics, available residential delivery addresses, advertiser participation, and the manner in which My Zip Ads organizes a particular market.
Accordingly, individual Mailing Areas may contain more or fewer than 10,000 residential delivery addresses, and My Zip Ads may establish smaller or larger Mailing Areas when appropriate for the particular community or market.
Advertising plan pricing is not based solely upon a fixed number of postcards, households, residents, or individual viewers.
A “Mailing Area” may consist of one ZIP code, portions of one or more ZIP codes, selected USPS carrier routes, neighborhoods, municipalities, adjoining communities, or other geographic areas selected by My Zip Ads.
My Zip Ads may divide a larger market into multiple Mailing Areas, combine appropriate neighboring areas, or adjust carrier routes and geographic distribution to create or maintain effective local advertising campaigns.
Where a particular campaign is expected to differ materially from My Zip Ads’ standard approximately 10,000-address campaign, the approximate distribution or geographic scope may be communicated to the Advertiser before campaign activation through a proposal, invoice, email, sales communication, order confirmation, or other written campaign communication.
The number of people who may potentially see or interact with a mailed advertisement may be greater than the number of residential delivery addresses because multiple people may reside at or visit a household. However, My Zip Ads does not guarantee any particular number of individual viewers, readers, impressions, or recipients beyond the direct-mail distribution itself.
Actual mailing quantities may vary reasonably because of USPS carrier-route counts, vacant addresses, postal changes, route modifications, production requirements, or similar operational circumstances.
My Zip Ads may divide a larger market into separate Mailing Areas or mailing segments. The same business category may therefore be represented by different advertisers in different Mailing Areas, provided the applicable protected Mailing Areas do not overlap.
The number of advertisers, postcard dimensions, layout, mailing routes, and distribution configuration may vary by campaign.
My Zip Ads may periodically rotate approved advertising designs, offers, headlines, or layouts for an Advertiser while maintaining the Advertiser’s general branding and approved business information.
βΈ»
2. ADVERTISING PLANS AND PAYMENT
My Zip Ads may offer advertising plans of varying lengths, including 1-month, 6-month, and 12-month plans.
Unless otherwise agreed in writing, payment is due at the time of purchase for an active Mailing Area.
The advertising term begins with the first scheduled mailing containing the Advertiser’s advertisement, rather than solely on the date payment is submitted.
Full payment, or another payment arrangement specifically approved by My Zip Ads, must be received before an advertising placement is confirmed for production.
Third-party payment, financing, or installment services, if offered, operate independently of My Zip Ads and are subject to the third party’s own terms, fees, approvals, and policies.
βΈ»
3. NEW MAILING AREAS AND CATEGORY RESERVATION DEPOSITS
A Mailing Area that has not yet been activated may require a launch period while My Zip Ads secures sufficient advertiser participation and prepares the campaign.
For a new or pending Mailing Area, My Zip Ads may, but is not required to, accept a $500 Category Reservation Deposit instead of requiring the Advertiser to pay the full advertising plan price immediately.
The reservation deposit:
-
reserves the Advertiser’s approved business category within the proposed Mailing Area during the activation period;
-
is credited in full toward the Advertiser’s selected advertising plan when the campaign is activated; and
-
does not begin the Advertiser’s paid advertising term.
My Zip Ads may allow up to 90 days from the reservation date to activate a new Mailing Area.
Once My Zip Ads confirms that the Mailing Area is ready to launch, the remaining balance for the selected advertising plan will become due before the Advertiser’s first mailing.
If My Zip Ads is unable to activate the Mailing Area within the 90-day activation period, the Advertiser may choose to:
-
continue the reservation period by mutual agreement;
-
transfer the deposit to another available Mailing Area or advertising opportunity; or
-
request a full refund of the Category Reservation Deposit.
When the refund results from My Zip Ads being unable to activate the Mailing Area within the applicable activation period, My Zip Ads will absorb its ordinary payment-processing costs and return the full refundable reservation deposit to the Advertiser.
If My Zip Ads has confirmed that the Mailing Area is launching and the Advertiser thereafter elects not to proceed after My Zip Ads has reserved the category or begun campaign preparation, the reservation deposit may become nonrefundable to the extent permitted by applicable law.
My Zip Ads may waive, reduce, or modify the reservation deposit through a written promotional offer or other written agreement.
βΈ»
4. CAMPAIGN ACTIVATION AND FULFILLMENT
My Zip Ads determines when a Mailing Area has sufficient participation and is operationally ready to begin regular mailing.
Once a campaign has been activated and the Advertiser’s advertisement enters production, My Zip Ads may make reasonable adjustments to postcard size, layout, number of advertisers, carrier routes, geographic distribution, print quantity, or mailing configuration when necessary because of advertiser participation, postal requirements, printing requirements, market configuration, or production conditions.
My Zip Ads may use an alternate or paired direct-mail format when reasonably necessary to complete a paid campaign, provided the Advertiser receives reasonably comparable advertising value and fulfillment.
My Zip Ads does not guarantee that the exact same residential addresses will receive every scheduled mailing. Carrier routes or mailing segments may rotate or change within an Advertiser’s applicable Mailing Area.
My Zip Ads does not guarantee any particular number of leads, calls, sales, customers, revenue, website visits, impressions, or other business results from an advertising campaign.
βΈ»
5. CATEGORY PROTECTION
My Zip Ads provides category protection within the applicable Mailing Area.
Once an Advertiser’s category has been approved and the required payment or approved Category Reservation Deposit has been received, My Zip Ads will not knowingly accept another advertiser in the same protected business category within the same protected Mailing Area during the Advertiser’s active term.
Category protection is based on the Advertiser’s approved primary business category and the products or services being promoted.
My Zip Ads reserves the right to reasonably define, interpret, and manage category classifications in order to address businesses offering multiple services, overlapping services, restaurants with different concepts, entertainment businesses, and other situations in which business categories are not identical.
A business offering multiple products or services does not automatically receive category protection for every product or service it offers.
Businesses operating from the same physical location or offering some overlapping products or services are not automatically considered members of the same protected category.
A business in another Mailing Area may occupy the same category as an existing Advertiser when the applicable protected Mailing Areas do not overlap.
Category availability is not permanently secured merely by submitting an inquiry or availability request. Category protection becomes effective after My Zip Ads approves the category and receives the applicable payment or approved Category Reservation Deposit.
Category protection continues through the Advertiser’s active paid term and any applicable payment grace period, provided the Advertiser remains in compliance with this Agreement.

6. ADVERTISING MATERIALS AND DESIGN
Advertiser is responsible for providing accurate business information, offers, logos, photographs, disclaimers, pricing, and other materials reasonably required to produce the advertisement.
Unless otherwise stated, initial ad preparation or design may be included with the advertising plan.
My Zip Ads will provide the Advertiser a reasonable opportunity to review and approve new artwork before initial printing.
Advertiser is responsible for reviewing spelling, pricing, telephone numbers, addresses, offers, expiration dates, legal disclosures, and all other advertising content.
Once artwork is approved by the Advertiser, Advertiser assumes responsibility for the accuracy of the approved content unless My Zip Ads subsequently changes the approved information incorrectly.
If Advertiser fails to respond by an established approval or production deadline, My Zip Ads may use the Advertiser’s most recently approved advertisement or design so that the scheduled mailing is not delayed.
My Zip Ads may make minor production adjustments that do not materially change the Advertiser’s message, including sizing, positioning, bleed, resolution, typography, or similar printing and production adjustments.
βΈ»
7. ADVERTISER DELAYS
Advertiser must provide requested artwork, information, approvals, and other materials by the deadlines established by My Zip Ads.
My Zip Ads is not responsible for a missed opportunity, delayed design, repeated advertisement, or other consequence caused by Advertiser’s failure to provide required information or approval by the applicable deadline.
An Advertiser’s failure to submit new artwork, information, or approval does not automatically pause, extend, cancel, or refund an active advertising plan.
βΈ»
8. AUTOMATIC RENEWAL
IMPORTANT: ADVERTISING PLANS PURCHASED AS AUTOMATIC-RENEWAL PLANS WILL RENEW AUTOMATICALLY AND THE PAYMENT METHOD ON FILE MAY BE CHARGED FOR ANOTHER TERM UNLESS THE ADVERTISER CANCELS BEFORE THE APPLICABLE CANCELLATION DEADLINE.
Unless otherwise stated at the time of purchase:
1-month plans automatically renew for additional 1-month terms unless canceled at least 7 days before the renewal date.
6-month plans automatically renew for additional 6-month terms unless canceled at least 30 days before the renewal date.
12-month plans automatically renew for additional 12-month terms unless canceled at least 30 days before the renewal date.
The renewal price will be the price disclosed for the applicable plan at checkout or otherwise agreed to by the Advertiser, subject to any price change properly disclosed before renewal.
For 6-month and 12-month plans, My Zip Ads intends to send a courtesy renewal reminder approximately 60 days before the scheduled renewal date when reasonably practicable.
The courtesy reminder does not constitute an early renewal charge.
Unless otherwise disclosed and authorized, the automatic renewal charge occurs according to the billing schedule displayed when the Advertiser purchases the plan.
Failure to receive or notice a courtesy reminder does not by itself cancel an otherwise valid automatic renewal, subject to applicable law.
Cancellation prevents the next renewal. It does not terminate or refund the Advertiser’s current paid term.
βΈ»
9. FAILED RENEWAL PAYMENTS AND GRACE PERIOD
If an automatic renewal payment is declined, expired, rejected, or otherwise cannot be processed, My Zip Ads may provide the Advertiser a grace period to update or correct the payment method.
Unless My Zip Ads communicates otherwise, the grace period may be up to 3 calendar days for a 1-month plan and up to 7 calendar days for a 6-month or 12-month plan.
During an applicable grace period, My Zip Ads may temporarily continue to protect the Advertiser’s category.
My Zip Ads is not required to produce or mail advertising for an unpaid renewal term while payment remains unresolved.
If payment is not successfully resolved within the applicable grace period, the advertising plan may expire and category protection may end.
Once category protection ends, My Zip Ads may make that category available to another advertiser.
My Zip Ads is not required to remove a newly accepted advertiser from a category because a former Advertiser later attempts to restore an expired or unpaid plan.
βΈ»
10. CANCELLATION OF FUTURE RENEWAL
Advertiser may cancel automatic renewal using the cancellation method made available through the My Zip Ads website, customer account, email, or another electronic cancellation method communicated by My Zip Ads.
Cancellation must be received before the applicable cancellation deadline stated in Section 8.
Cancellation applies to future renewal only. The Advertiser remains entitled to advertising and category protection through the end of the current paid term, provided the account remains in good standing.
There is no penalty for canceling a future automatic renewal.
βΈ»
11. REFUNDS
Once an active campaign has been confirmed for production and fulfillment has begun, the advertising plan is non-cancelable during its current paid term except as expressly provided in this Agreement or required by law.
Advertiser will not receive a refund because the advertisement produces fewer leads, calls, customers, sales, website visits, or other business results than expected.
No refund or credit is required for delays or problems caused by the Advertiser, including failure to provide artwork, information, approvals, or requested materials by the applicable deadline.
If My Zip Ads cannot provide a paid advertising placement or remaining paid mailing, My Zip Ads may first offer reasonably comparable replacement fulfillment or a credit acceptable to the Advertiser.
If My Zip Ads permanently cannot provide the paid service and a mutually acceptable replacement or credit cannot be provided, My Zip Ads will refund the amount attributable to the undelivered portion of the purchased advertising service.
When a refund is required because My Zip Ads cannot provide the purchased service, My Zip Ads will not deduct its ordinary payment-processing costs from the amount otherwise refundable to the Advertiser.
If an Advertiser requests a cancellation, refund, or accommodation for reasons not caused by My Zip Ads and My Zip Ads voluntarily agrees to provide one, My Zip Ads may deduct actual nonrefundable third-party processing fees and reasonable costs already incurred, to the extent permitted by applicable law.
Nothing in this Agreement limits any refund or other remedy that cannot legally be waived.
βΈ»
12. USPS, PRINTING, AND DELIVERY
Advertiser acknowledges that USPS delivery dates and delivery to every individual residential address cannot be guaranteed.
My Zip Ads is not responsible for isolated nondelivery, postal delays, carrier-route changes, USPS operational issues, or delays caused by third-party printers, transportation providers, or other circumstances outside My Zip Ads’ reasonable control.
Mailing quantities and residential delivery-address counts are estimates and may vary because of changes to postal carrier routes, vacant addresses, route counts, USPS requirements, or similar operational conditions.
Submission of properly prepared mail to USPS or an authorized mailing facility constitutes initiation of the applicable mailing for purposes of fulfillment.
βΈ»
13. OPTIONAL SOCIAL MEDIA, VIDEO, AND DIGITAL SERVICES
Social media management, social media posting, video production, digital advertising, and other digital marketing services are not included in the standard My Zip Ads direct-mail advertising plan unless specifically stated otherwise in writing.
Advertisers may contact My Zip Ads to request optional social media, video, or digital marketing services.
Any such service will be subject to a separate written proposal, invoice, order, addendum, or service description specifying the applicable price, frequency, scope, term, and deliverables.
Purchasing a direct-mail advertising plan alone does not entitle the Advertiser to social-media posts, videos, video production, boosting, paid digital advertising, or social-media management.
My Zip Ads may occasionally feature or share an Advertiser or its content through My Zip Ads’ own marketing channels at My Zip Ads’ discretion. Any such complimentary exposure is voluntary, is not guaranteed, and does not become part of the Advertiser’s purchased advertising package unless specifically agreed to in writing.
βΈ»
14. ADVERTISER CONTENT AND RIGHTS
Advertiser represents that it has the right to use all trademarks, logos, photographs, videos, artwork, offers, statements, and other materials supplied to My Zip Ads.
Advertiser is responsible for the truthfulness and legality of its advertising claims, prices, promotions, offers, licenses, disclaimers, and other business representations.
Advertiser grants My Zip Ads a non-exclusive, royalty-free license to reproduce, resize, format, modify as reasonably necessary for production, print, display, and distribute materials supplied or approved by Advertiser for purposes of providing the purchased advertising services.
Advertiser also permits My Zip Ads to display completed advertising materials as examples of My Zip Ads’ work unless Advertiser requests otherwise in writing.
My Zip Ads may reject or require modification of advertising material that it reasonably believes is unlawful, misleading, infringing, offensive, inappropriate, or inconsistent with the format or standards of a My Zip Ads campaign.
βΈ»
15. INDEMNIFICATION
Advertiser agrees, to the extent permitted by applicable law, to indemnify and hold harmless My Zip Ads LLC and its officers, employees, contractors, and agents from third-party claims, damages, liabilities, or reasonable costs arising from materials, representations, offers, intellectual property, products, services, or advertising content supplied or approved by Advertiser, except to the extent caused by My Zip Ads’ own wrongful or unlawful conduct.
βΈ»
16. LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, My Zip Ads LLC will not be liable for indirect, incidental, special, exemplary, or consequential damages, including lost profits, lost revenue, lost business opportunities, or anticipated advertising results arising from an advertising campaign.
Except where prohibited by law and except for refunds expressly required under this Agreement, My Zip Ads’ aggregate liability arising from a particular advertising placement or service will not exceed the amount actually paid by Advertiser to My Zip Ads for the portion of the advertising service giving rise to the claim.
Nothing in this Agreement excludes or limits liability that cannot lawfully be excluded or limited.
βΈ»
17. FORCE MAJEURE
My Zip Ads will not be responsible for a delay or failure caused by circumstances beyond its reasonable control, including severe weather, natural disasters, postal interruptions, government actions, labor disruptions, transportation interruptions, printing-facility failures, widespread technology outages, or similar events.
My Zip Ads will use commercially reasonable efforts to reschedule or otherwise fulfill affected advertising when practicable.
βΈ»
18. ELECTRONIC ACCEPTANCE
Advertiser agrees that this Agreement may be accepted electronically.
By completing an online purchase through My Zip Ads, submitting payment after being provided access to this Agreement, clicking an electronic acceptance control if one is provided, or otherwise electronically accepting an advertising order that incorporates this Agreement, Advertiser acknowledges that it has had an opportunity to review this Agreement and agrees to be bound by its terms.
Advertiser agrees that electronic acceptance and electronic records may be used to evidence the transaction to the extent permitted by applicable law.
My Zip Ads may retain electronic records of the transaction, including the Advertiser’s identifying information, purchase, payment record, date and time of transaction, selected advertising plan, and version of the applicable Agreement or Plan Policy.
βΈ»
19. GOVERNING LAW AND VENUE
This Agreement is governed by the laws of the State of Illinois, without regard to conflict-of-law principles.
To the extent permitted by applicable law, any legal action arising from this Agreement shall be brought in a court of competent jurisdiction located in Cook County, Illinois.
The parties are encouraged to attempt in good faith to resolve a dispute informally before initiating legal proceedings.
βΈ»
20. CHANGES TO THIS AGREEMENT
My Zip Ads may update this Agreement from time to time.
Changes will not retroactively alter the material terms of an Advertiser’s current paid term unless agreed to by the Advertiser or otherwise permitted by law.
Any material changes affecting an automatic renewal will be communicated as required by applicable law.
The version presented or incorporated into the Advertiser’s purchase governs that purchase unless subsequently modified by a written agreement between the parties.
βΈ»
21. SEVERABILITY
If any provision of this Agreement is determined to be invalid or unenforceable, the remaining provisions will continue in effect to the fullest extent permitted by law.
βΈ»
22. ENTIRE AGREEMENT
This Agreement, together with the applicable advertising plan, checkout disclosures, Plan Policy, invoice, order confirmation, campaign-specific written communications, and any written addendum specifically agreed to by My Zip Ads and Advertiser, constitutes the agreement between the parties regarding the purchased advertising services.
If a specific written order, proposal, or addendum expressly modifies a provision of this Agreement for a particular campaign or service, the more specific written provision will control with respect to that campaign or service.
Oral statements by a salesperson, representative, or other person do not modify this Agreement unless the modification is confirmed in writing by My Zip Ads.
βΈ»
23. CONTACT AND CANCELLATION REQUESTS
Questions concerning an advertising plan, Mailing Area, category protection, renewal, or cancellation may be submitted through the contact methods provided on the My Zip Ads website.
Advertisers who purchase an advertising plan online will be provided an online or electronic method for canceling future automatic renewal.
